These Terms and Conditions govern your use of www.pestbang.com (the "Website") and the purchase of products from PESTBANG ("we", "us", "our", or "PESTBANG") a sole trader entity registered in New Zealand.

By accessing the Website, creating an account, or placing an order with us, you agree to be bound by these Terms and Conditions and our Privacy Policy.

 If you do not agree to these Terms, you must not use the Website or place an order.

We may update these Terms from time to time by posting the updated version on the Website. Changes will take effect immediately upon posting (unless otherwise stated). Your continued use of the Website or any order placed after changes are posted constitutes acceptance of the updated Terms.

 

### 1. Orders and Contract Formation

1.1 All orders are subject to acceptance by us. We may refuse or cancel any order at our discretion (e.g., if the product is out of stock or pricing error).

1.2 A binding contract is formed when we send you an order confirmation email.

1.3 We reserve the right to limit quantities or cancel orders if we suspect fraudulent activity or breach of these Terms.

 

### 2. Prices and Payment

2.1 Prices are in New Zealand Dollars (NZD) and include GST unless otherwise stated.

2.2 Prices may change without notice, but changes will not affect orders already confirmed. 

2.3 Payment must be made in full at the time of order via bank deposit or credit card purchase. 

2.4 We use STRIPE secure payment gateway on checkout. We do not store your full payment details.

 

### 3. Delivery

3.1 We deliver within New Zealand only. 

3.2 Delivery times are estimates only. We are not liable for delays caused by couriers or events beyond our control. 

3.3 Risk in the products passes to you upon delivery. Title passes when payment is received in full. 

3.4 Delivery charges are shown at checkout.

 

### 4. Product Descriptions, Images and Specifications – Disclaimer

We make every reasonable effort to ensure that all product descriptions, specifications, dimensions, images, and prices displayed on the Website are accurate and current at the time of publication.

However:

 - Images are for illustrative purposes only. Actual products may vary slightly in colour, texture, finish, or appearance due to lighting, photography, screen settings, or natural manufacturing variations.

- Colours shown on your device may differ from the actual product due to monitor/display calibration differences.

- Measurements and weights are approximate and may vary within normal manufacturing tolerances.

- We may update or change product specifications without prior notice (including after an accepted order if the change is required by law or does not materially affect the product).

To the maximum extent permitted by law, and subject always to your non-excludable rights under the **Consumer Guarantees Act 1993** and **Fair Trading Act 1986**, we do not warrant that product descriptions, images, specifications, or other content on the Website is accurate, complete, reliable, current, or error-free.

We will not be liable for any loss or damage arising from your reliance on product information on the Website where that information contains an error or omission, except where we are required to be liable under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.

 

### 4. Returns, Refunds and Consumer Guarantees Act 1993 

4.1 Change of Mind Returns (Voluntary Policy – Not Required by Law)

We offer a 30-day change of mind return policy on most items provided:

- The product is unused, in original packaging, and in resalable condition;

- You provide proof of purchase;

- You pay return shipping (unless we sent the wrong item);

 

Refunds will be processed within 7–10 business days of receiving the returned item.

 

#### 4.2 Consumer Guarantees Act 1993 (CGA) – Your Statutory Rights

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993.

Our goods come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage if you have followed all application instructions which are included with every purchase. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

If you are purchasing for business purposes, you agree the CGA does not apply.

 

#### 4.3 Faulty or Incorrect Items

If we send the wrong or damaged item, we will cover return shipping and rectify the issue promptly.

 

### 5. Fair Trading Act 1986 (FTA) – Compliance Statement

We comply fully with the Fair Trading Act 1986 and do not engage in misleading or deceptive conduct, false representations, or unfair practices. 

Nothing in these Terms excludes or limits your rights under the FTA that cannot lawfully be excluded. 

If you believe any representation on our Website is misleading, please contact us immediately so we can correct it.

 

### 6. Limitation of Liability

To the maximum extent permitted by law (and subject to your non-excludable rights under the CGA and FTA), our liability is limited to the purchase price of the product concerned. We are not liable for indirect or consequential loss.

 

### 7. Intellectual Property

All content on the Website is owned by us. You may not reproduce it without permission.

 

### 8. Privacy

We comply with the Privacy Act 2020. 

 

### 9. Force Majeure

We are not liable for failure to perform due to events beyond our reasonable control.

 

### 10. Governing Law

New Zealand law applies. New Zealand courts have non-exclusive jurisdiction.
